General Terms and Conditions (AGB)

Scope
These terms and conditions apply to all contracts between Digital Creative Production Agency and its clients for wedding, pre-wedding, and portrait photography services. Any deviating terms and conditions of the client shall not apply unless expressly agreed upon in writing.

Contract Conclusion
The contract betweenDigital Creative Production Agency and the client is concluded by the client's written acceptance of the offer made by Digital Creative Production Agency. The offer shall specify the scope of services, the price, and any other relevant terms and conditions.

Services
Digital Creative Production Agency offers photography services for weddings, pre-weddings, and portrait shootings. The scope of services shall be specified in the offer made by Digital Creative Production Agency and accepted by the client. Digital Creative Production Agency shall perform the services with due care and in accordance with the applicable professional standards.

Prices and Payment
The prices for Digital Creative Production Agency's services shall be specified in the offer made byDigital Creative Production Agency and accepted by the client. Unless otherwise agreed upon in writing, the client shall pay Digital Creative Production Agency a deposit of 30% of the total price upon conclusion of the contract. The remaining amount shall be paid upon delivery of the photographs.

Delivery of Photographs
Digital Creative Production Agency shall deliver the photographs to the client within a reasonable time after the shooting, unless otherwise agreed upon in writing. The photographs shall be delivered in the format and quality agreed upon in the offer made by Digital Creative Production Agency. Any claims for defects shall be asserted by the client within two weeks after delivery of the photographs.

Copyright and Usage Rights
Digital Creative Production Agency retains the copyright to the photographs. The client shall be granted a non-exclusive, non-transferable usage right to the photographs for personal use only. Any commercial use of the photographs shall require Digital Creative Production Agency's prior written consent.
2. Copyright and Usage Rights 2.1 The Photographer retains the copyright and usage rights to all photographs taken during the photo session. 2.2 The Photographer is permitted to use the photographs for their own promotional purposes, including but not limited to advertising, portfolio displays, and contests. 2.3 The Photographer has the right to choose which photographs to display publicly and may edit the photographs at their discretion without seeking further agreement from the Client. 2.4 For TFP (Time for Print) projects, the Client acknowledges that the photographs will be displayed publicly. It is the Client's responsibility to inform the Photographer if there are any restrictions to the display of the photographs. Once the photographs have been displayed publicly, the Photographer cannot guarantee that they will be removed. 2.5 The Client may use the photographs for personal use only and may not sell or distribute the photographs without the Photographer's written consent. Any commercial use of the photographs must be negotiated separately with the Photographer.

Liability
Digital Creative Production Agency shall be liable for damages caused by intent or gross negligence. Any other liability, in particular for slight negligence, shall be excluded.

Applicable Law and Place of Jurisdiction
The contract between Digital Creative Production Agency and the client shall be governed by Austrian law. The place of jurisdiction shall be the competent court at Digital Creative Production Agency's registered office.

Severability Clause
If any provision of these terms and conditions is or becomes invalid, the validity of the remaining provisions shall not be affected thereby. The invalid provision shall be replaced by a valid provision that comes as close as possible to the economic purpose of the invalid provision.
